TERMS AND CONDITIONS

By entering the 2009 EnhanceTV ATOM Film Television and Multimedia Awards (‘Awards’) Award entrants (‘Entrants’) agree to be bound by the following terms and conditions. Failure to abide by these terms and conditions may render an Entrant ineligible for the Awards regardless of payment of the Award Fees.

  1. Entrants must submit their entries in the following manner:
    1. Film, TV and video entries must be submitted as per specifications outlined below (point # 12 and 13);
    2. Multimedia entries must be submitted on CD or DVD or URL;
    3. Multimedia entries must include necessary software, passwords and instructions for viewing the production which is the subject of the entry;
    4. A URL must be submitted for website entries. Access codes for member specific areas must be clearly noted and attached to the entry form. If judges are unable to access the URL due to server or site error, this may render the Entrant ineligible for the Awards regardless of payment of the Award fee.
  2. An Entrant may submit a production into more than one Award category provided that the Entrant pays the requisite Award Fee for each category. Details of the Award Fees and the methods of payment are outlined on this entry form.
  3. An Entrant may submit multiple productions into any given Award category provided that the Entrant pays the requisite Award Fee for each production submitted.
  4. An Entrant must supply additional copies of the Entrant’s production for each Award category entered. For example, if an Entrant enters the same title in three categories the Entrant must provide ATOM with three copies of the production in the appropriate media for each relevant category (described at 1 above), and three copies of each of the completed Entry Forms and synopsis.
  5. ATOM reserves the right to re-categorise entries if ATOM, at its sole discretion, considers that it is appropriate to do so.
  6. Primary and Secondary schools are limited to five (5) entries for the flat rate Award Fee of $77.00. Any additional entries cost $11.00 per production.
  7. To be eligible for the Awards, Entrants must complete the online entry form (including the provision of details of their intended audience) - found under the 'ATOM Awards 2009 / Enter the ATOM Awards' section on the website.
  8. All productions which are entered for an Award must have been completed between 1 January 2007 and 31 March 2009.
  9. Entries will be accepted at the EnhanceTV ATOM Awards Office, PO Box 16, Altona, Vic, 3018 or 14a Dalgety St, St Kilda, Vic, 3182 Australia NO LATER than 12pm Monday 15 June, 2009.
  10. Productions entered in previous ATOM Awards are ineligible for the 2009 Awards.
  11. ATOM reserves the right to use entrant content (including part of any production submitted by an Entrant) in any form it chooses for the 2009 EnhanceTV ATOM Awards. Submission of an entry for an Award by an Entrant constitutes consent by that Entrant for ATOM to use that Entrant’s name and photo for publicity purposes.
  12. If Entrants are short-listed as Finalists, the entrants must submit a 65 second, 35 second and 15 second clip of their production, as per below.

    - standard definition 16:9 720 x 576 anomorphic
    - SD 4:3 720 x 576
    - HD 1920 x 1080 interlaced or progressive
    - HDV 1440 x 1080 interlaced or progressive
    - HD 720 x 1280 progressive

    Accepted media:

    - quicktime (any codec)
    - .avi
    - .wmv
    - Mini DV
    - Digital Betacam
    - Betacam SP
    - Betacam SX
    - MPEG IMX
    - DVD with no CSS or Macrovision
  13. Each Finalist must also submit a separate disc, containing no more than 5 still images should be provided for use in pre-event promotions, media promotion etc.
    Each still MUST be titled with the name of the production and any other relevant reference.
    Only the following formats will be accepted:
    •           Jpeg
    •           Bitmap
    •           Tiff
    * Please DO NOT zip files on the disc, provide as individually accessible images only.
  14. ATOM reserves the right to use the Clip (including any part of the Clip) in any form it chooses for the purpose of promotion and publicity for the 2009 EnhanceTV ATOM Awards. Submission of a Clip by an Entrant constitutes consent by that Entrant for ATOM to use the Clip for publicity purposes and for the Awards presentation.
  15. An Entrant is solely responsible for ensuring that all necessary copyright and other relevant rights and authorisations for an Entrant’s productions have been obtained prior to submitting an entry. ATOM takes no responsibility for any failure by an Entrant to obtain the necessary authorisations. Entrants warrant that their productions (and any material comprising their productions, including not limited to any Clip) do not infringe the intellectual property or any rights of any person. Entrants will fully indemnify ATOM against any loss, costs, expenses, demands or liability, whether direct or indirect, arising out of a claim by a third party or another party. If requested by ATOM, entrants must provide irrevocable consent to ATOM in its absolute discretion reproducing, publishing, copying, adapting, performing, communicating, showing or exhibiting in or to the public, materially distorting, altering or in any other way changing or using the productions or (where applicable) a substantial part or adaptation of it with or without authorship; in any medium; in any context; and in any way ATOM sees fit.
  16. The Award judges’ decision is final and no correspondence or discussion will be entered into regarding the judging process or any outcomes reached.
  17. Award Fees will not be refunded.
